Troubles seems not to be over for the national chairman of the Peoples Democratic Party (PDP), Adamu Mu’azu as another fresh suit seeking to unseat him has been filed before the Federal High Court sitting in Abuja, barely two days after two initial separate suits were withdrawn.
The plaintiff, a member of the House of Representatives on the platform of PDP, Aliyu Garba Gubrin, through his counsel, Lilian Ojimma had approached the court contending that Mu’azu cannot preside over the affairs of the party because his appointment as the chairman did not follow due process. Already, Mu’azu is gearing up to chair the party’s National Convention billed for December 6,2014 where President Goodluck Jonathan is expected to emerge as the Presidential candidate of the party.
The plaintiff, in an originating summons with suit number FHC/ABJ/CS/821/2014 and dated November 5, 2014 is also challenging the purported resignation of he former chairman of the party, Alhaji Bamanga Tukur.
The PDP, through its counsel, Kwor Victor has, however, filed a memorandum of appearance.
The case has been assigned to Justice Evoh Chukwu of Court 8 and and is slated to come up on November 12.
Joined as defendants in the suit are the former chairman of the party, Alhaji Bamanga Tukur, Mu’azu and the Independent National Electoral Commission (INEC).
The plaintiff is praying the court to determine whether the resignation of Tukur on january 15, 2014 duly comply with Section 47(5) of the Constitution of the party.
He also wants the court to declare that Tukur’s resignation is invalid for non compliance with the Constitution of the party and the electoral Act 2010.
The plaintiff further asked the court for an order setting aside the resignation of Tukur as the party chairman.
He also wants the court to make an order stopping INEC from recognising Mu’azu as the chairman of the party.
He further wants the court to restrain Mu’azu from parading himself as the chairman of the PDP.
It will be recalled that two members of the party, asking the court to sack Mu’azu, withdrew their suit last Thursday.
The plaintiffs, Ezinoye Louis Ndubuisi and Emmanuel Onu, said they took the decision in the best interest of the party.
